The private company EuroWheelz B.V. based in Houten (“EuroWheelz”, “we”, “us”) processes personal data. In this privacy statement we explain which personal data we process, on which bases and for which purposes.

To whom does this privacy statement apply?

This privacy statement applies to:

• individuals whose personal data we process in the course of providing our services;
• persons visiting the website www.eurowheelz.eu / www.eurowheelz.nl;
• individuals who receive a newsletter from us;
• contacts of (business) customers or suppliers;
• Persons who book a tour with our E-choppers through EuroWheelz and/or rent an E-chopper from us;
• persons booking a test drive;
• persons using our service;
• individuals who create an account on one of our websites;
• individuals who contact us by email, phone or through the contact form on our websites;
• persons who otherwise contact us or from whom we otherwise process personal data.

What terms are used in this privacy statement?

In this privacy statement, the following terms are defined as follows:

What personal data do we process from you for rental purposes?

The personal data we process from you are:

• Personal data provided to us by you:
• contact information (including name, first name, e-mail address, phone number);
• number driver’s license;
• company data;
• data for the purpose of our services (e.g. ascription, license plate registration, data we need for the (re)hiring of our E-choppers with our consignment partners, issue points and the managers of our E-choppers);
• Data that you provide to us when visiting our website and/or webshop;
• financial information (including bank account number);
• Other data whose processing is required under applicable laws or regulations.

Based on which AVG bases and for which purposes do we process your personal data?

EuroWheelz processes your personal data on the basis of one or more of the following bases:

1. When necessary for the performance of a contract to which you are a party or the performance of pre-contractual acts at your request;
2. When necessary to fulfill a legal obligation;
3. When necessary to protect our legitimate interests or the interests of a third party;
4. When you have given permission.

EuroWheelz processes the above personal data for the purposes listed below:

To whom do we provide your personal data?

EuroWheelz may share your personal data with:

• vendors (including software vendors, accountants, hosting vendors);
• Legal entities affiliated with EuroWheelz, including Spyder Wheelz BV;
• To our consignment partners in connection with the (re)hiring of E-choppers;
• other parties such as government agencies, courts and regulators.

EuroWheelz will not provide your personal data to third parties other than those mentioned above, unless this is necessary for achieving the purposes stated in this privacy statement, if EuroWheelz is under a statutory obligation or if you have given us your explicit consent. The third parties to whom we provide personal data are obliged to keep your personal data confidential and adequately secured. If these parties are considered “processors” in the sense of the AVG, we will conclude processing agreements with these third parties.

Transfer of personal data to countries outside the European Economic Area (EEA)

In principle, EuroWheelz processes your personal data only within the EEA. If personal data is transferred to a country outside the EEA, EuroWheelz will ensure appropriate safeguards to guarantee that the transfer takes place in accordance with the AVG.

Third party websites

Our website contains links to our social media channels. EuroWheelz is not responsible for third-party websites and the way third parties handle your personal data.

Security

EuroWheelz has taken appropriate organizational and technical measures to protect your personal data as much as possible against unauthorized or unlawful processing and against loss, destruction, damage, modification or publication. For questions about the security of your personal data or if you suspect misuse, please contact us. Our contact details are listed at the bottom of this statement.

How long do we keep your personal data?

EuroWheelz will not retain your personal data in an identifiable form for longer than is necessary to achieve the purposes stated in this privacy statement. More specifically, EuroWheelz applies the following retention periods:

• Data related to the agreement concluded with you

We anonymize your data that we process in our reservation system no later than 7 years after our relationship has ended. We assume that our relationship has ended when you do not make a new booking with us in the following 7 years or an agreement between you and EuroWheelz has been terminated by either party.

• Financial data

We keep our financial records for 10 years. This means that all your data and documents related to financial transactions between you and EuroWheelz will be kept for 10 years after your booking.

• Data we record during contact moments

Recorded telephone calls and WhatsApp conversations are deleted within 3 months. Email messages sent to you or received by us and complaints filed by you will be kept for up to 10 years.

• Reviews

We store your reviews posted on our websites for up to 2 years after the review was posted. After the (legal) retention period, your personal data will be destroyed. (Legal) retention periods may change. The above does not apply in case there is a legal obligation on us to keep certain personal data longer.

Privacy rights

You have the following rights regarding our processing of your personal data:

1. The right to access the personal data we process about you;
2. The right to have your personal data amended or corrected if it is inaccurate or incomplete;
3. The right to object to the processing of your personal data if you have a legitimate reason to do so;
4. The right to restrict the processing of your personal data in some cases;
5. The right to request that your personal data be transferred to a third party (“the right to data portability”);
6. The right to have your personal data deleted (“the right to be forgotten”);
7. The right to withdraw consent to the processing of personal data if the processing is based on your consent. This includes the right to unsubscribe from our newsletter or e-mails. The withdrawal of your consent does not affect the lawfulness of the processing of your personal data prior to the withdrawal.

We will inform you within one month of receiving your request whether we can fulfill it. This period can be extended by two months in exceptional cases, for example in case your requests are extensive. We will inform you of such an extension within one month of receiving your request.

We may not be able or allowed to fulfill your request(s) (in full). If we deny your request (in part), we will explain why.

To prevent us from providing information to the wrong person, we may ask for additional information to verify your identity. Never send us an unsolicited copy of your ID.
